This is the privacy policy of ScaleUp Agency. In it, we explain in plain language what data we collect and what we use it for. We also explain how you can access it, correct it or ask us to delete it.

Our privacy policy in short

We only collect the data you send us through the form, on WhatsApp or when you book a meeting, as well as some basic technical browsing data.
We use it to reply to you, prepare your proposal and, if we work together, handle your project.
In addition, we do not sell or rent your data to anyone.
You can access it, correct it or ask us to delete it whenever you want, free of charge.

The controller of your data is Robert Riera, who operates under the ScaleUp Agency brand, a digital marketing agency based in Barranquilla, Colombia, that works 100% remotely.

What data we collect

Data you send us

When you fill out the contact form, we collect:

Required: your full name, your email, your WhatsApp or phone number, what you want to achieve and what you tell us about your business.
Optional: the name of your company or website, the service you are interested in and when you would like to start.
Your acceptance of this policy, with the date and time of submission.

If you write to us on WhatsApp or by email, we also receive your number or your email address and what you write to us.

If you book a video call on our booking calendar (Google Calendar), we receive your name, your email, your WhatsApp number and your answers to the booking questions. We only use them to prepare for and hold the meeting.

Data collected while you browse

In addition, the website records some technical data: your IP address, your browser, your device type and the page you came from. If you arrived from an ad or a campaign link, it also records that source. In general, we use this data for site security and to measure, in aggregate, how the website is used.

What we use your data for

To reply to your message and contact you through the channel you gave us.
To understand your business and then prepare a proposal aligned with what you need.
If you hire our services, to coordinate and carry out the project, and to issue billing documents.
To protect the site against spam, fraud and unauthorized access.
To measure how the website is used, in aggregate, so that we can improve it.

In addition, we do not use your data to send you advertising you have not requested, and we do not sell or rent it.

Your authorization under this privacy policy

We process your data with your prior, express and informed authorization. You give it when you check the box on the form, when you write to us on your own initiative on WhatsApp or by email, or when you book a meeting on our calendar.

You can revoke that authorization at any time, except when we have a legal or contractual duty to keep the data.

Who we share your data with

We do not share your data with third parties for their own purposes. However, to run the website and serve you, we use some providers that process data on our behalf:

Provider	Purpose
Hostinger	Hosting for the website and the agency’s email. A copy of the form messages is also stored there, in the website database (Flamingo plugin).
Google	Email management, site analytics with Google Analytics, the booking calendar (Google Calendar and Google Meet) and the public reviews from our Google Business Profile that are shown on the website.
Trustindex	Plugin that shows public Google reviews on the website.
Wordfence	Site security: it filters malicious traffic and logs access attempts.
WhatsApp (Meta)	Conversations when you decide to write to us on WhatsApp.

We may also share data when a competent authority requires it in accordance with the law.

International transfers under this privacy policy

Some of these providers store data on servers located in the United States, the European Union or other countries. Therefore, by accepting this privacy policy, you authorize that international transfer. In addition, we only make it with providers that offer adequate security measures.

We also serve people and companies from different countries. That is why, if you reside in the European Union or the United Kingdom, you can also exercise the rights granted by your local regulations through the same channels.

Cookies and analytics

We use two types of cookies:

Technical and security cookies: necessary for the website to work and to protect it.
Analytics cookies: Google Analytics tells us, in aggregate, how many people visit the website, which pages they view and where they come from. However, we do not use it to identify you.

For now, we do not use advertising cookies or social media pixels. If we activate any of them in the future, we will update this policy before doing so.

You can block or delete cookies in your browser settings. If you only want to turn off analytics, Google offers the Google Analytics opt-out browser add-on.

How long we keep your data

Inquiries that do not turn into a project: up to two years, in case we pick up the conversation again.
Clients: for as long as the business relationship lasts and, after that, for the time required by accounting, tax or legal regulations.

If you ask us to delete your data before then, we will do so, unless a legal obligation requires us to keep it.

How we protect your data

We apply reasonable technical and organizational measures: an encrypted connection (HTTPS), a firewall, spam protection on the form, regular updates, authenticated email and restricted access to information. No system is infallible, but we work to keep your data protected.

Your rights

As the owner of your data (the data subject), the law grants you the following rights:

To access, update and correct your data.
To request proof of the authorization you gave us.
To know how we have used your data.
To revoke the authorization or ask us to delete your data, when there is no legal or contractual duty to keep it.
To access your data free of charge.
To file complaints with the Superintendencia de Industria y Comercio (Superintendence of Industry and Commerce), after you have first submitted your inquiry or claim to us.

How to exercise your rights

Write to us at contacto@somosscaleup.com with the subject “Data request”. Also include your name, the email or phone number you used to contact us and what you need. If you are acting on behalf of another person, provide proof that you represent them.

Inquiries

To find out what data we hold and how we use it.

Response within 10 business days at most

If we need more time, we will tell you why and reply within 5 additional business days at most.

Claims

To correct, update or delete your data, or to revoke your authorization.

Response within 15 business days at most

If we need more time, we will tell you why and reply within 8 additional business days at most.

When your claim is missing information, we will ask you to complete it within the following 5 days. In addition, if two months pass without a response from you, we will understand that you have withdrawn the claim.

Minors and sensitive data

This website is intended for businesses and professionals. Therefore, we do not knowingly collect data from minors. Nor do we ask for sensitive data, such as health, ethnic origin, beliefs or political orientation. That is why we ask you not to include it in your messages.

Links to other sites

The website links to other sites, such as those of our clients, our social media or robertriera.com, our founder’s website. Each site has its own privacy policy, so we are not responsible for how they process your data.

Changes to this privacy policy

We may update this policy, for example, if we add a new tool. When the change is significant, we will publish it here with the new effective date before applying it.
